Terms and Conditions
You agree, by enrolling in Firstbank's Online Banking Service ("Personal eBanking"), to the addition of the following to the rules governing your accounts with the Bank (the "Rules"). Terms not otherwise defined have the meanings given to them in the Rules. Personal eBanking allows you to transfer funds and review account activity using a personal computer ("PC"). Please read these additional rules carefully and retain them for your records. We have the right to change the Rules at any time by notice mailed or emailed to you at the last address or email address shown for your Account, as defined below, on our records as provided in the Rules, or as otherwise permitted by law.
Section 1. Definitions
"Checking Account" means the checking account you designated when you enrolled for Personal eBanking or as subsequently changed. "Account(s)" means the Checking Account and the deposit, loan and other accounts you have at the same Bank to which you have access through Personal eBanking. "Business Days" are Monday through Friday, except bank holidays. "You" and "your" refers to the person(s) or entity subscribing to or authorized to use Personal eBanking; "we," "us" and "our" refers to Bank. "Cutoff times" are times after which transactions will be processed the following business day and are, unless noted otherwise, 5:00p.m. (local Michigan time).
Section 2. Personal eBanking
Personal eBanking is an electronic banking service available to you through a PC using an access method specified in Section 3. You may use Personal eBanking to check the balance in and recent activity of each of your Accounts. You may transfer funds between your Eligible Accounts (see Section 6).
The Accounts to which you may have access through Personal eBanking are your checking accounts, savings accounts, installment loan accounts, mortgage loan accounts, home equity accounts, line of credit accounts, certificate of deposit accounts, and individual retirement accounts.
Section 3. Accessing your Account(s)
Firstbank's Personal eBanking is designed for Internet ("Internet") access. Firstbank will not provide or be responsible for any software, user's guides or upgrades. In order to utilize Internet access, you must use Microsoft Internet Explorer 7.0 (or higher) with 128-bit encryption, Mozilla Firefox 3.5 (or higher) with 128-bit encryption, Google Chrome 9.0 (or higher) with 128-bit encryption, Apple Safari 4.0 (or higher) with 128-bit encryption. The Internet web site for Personal eBanking is located at " http://www.firstbankmi.com" or such other Internet addresses as we may provide. No additional software is required for Internet access. Information is not stored on your PC unless you specifically download it to your PC. Bank has no control over and will not be responsible for the content of any software used to access the Personal eBanking site.
Section 4. User Identification and Password
After your Personal eBanking enrollment application has been processed and your account status is verified, Firstbank will generate a random User ID that will be mailed to you. A temporary Password will be emailed to you. You will need to log into Personal eBanking the first time using this temporary User ID and Password. You will be required to change both your User ID and Password at that time. The User ID you select can contain alphabetic or numeric characters or a combination. The Password must be a minimum of six (6) characters, of which two must be numeric. You can change your Password on Personal eBanking at any time and it is recommended that you change it at least every 6 months. You authorize Bank to follow any instructions entered through Personal eBanking using your Logon ID and Password. Your access to Personal eBanking will be blocked in the event your Logon ID or Password is entered incorrectly on three (3) consecutive access attempts. If this occurs, please call Personal eBanking Support at (800) 453-8700 and follow the prompts to be transferred to a Firstbank Customer Service Representative. Because your Logon ID and Password can be used to access money in any of your linked Accounts and to access information about any of your linked Accounts, you should treat your Logon ID and Password with the same degree of care and secrecy that you use to protect other sensitive financial data. You agree not to give your Logon ID or Password, or make them available, to any other person.
Section 5. Transfers
Transfers may be made between Eligible Accounts. An "Eligible Account" is an Account linked to Personal eBanking that does not have withdrawal restrictions, such as a certificate of deposit. To schedule a transfer of funds between Eligible Accounts, you must provide the Eligible Accounts from and to which the transfer is to be made and the amount to be transferred. Any attempted transfer which exceeds the available balance in the Eligible Account from which the funds are to be transferred will not be processed.
After you send the transfer instructions, a confirmation with the date and time of the transfer will be displayed. Transfers of available funds may be made any day at any time. Funds from transfers made after 5:00 p.m. local Michigan time will be credited the next business day. Payments on eligible loan accounts can be made by means of transfers from eligible accounts using Personal eBanking. Payments to Christmas club accounts can be made by means of transfers from eligible accounts using Personal eBanking and withdrawals from Christmas club accounts are not allowed.
Section 6. Account Inquiries
You may use Personal eBanking to check the balances and recent activity of your Accounts. You may also view images of your posted checks and view images of your current and prior month statements.
Section 7. Statements
All of your transfers made through Personal eBanking will appear on your Account statement(s). The transfer amount and date posted will be reflected for each transfer made through Personal eBanking. It is your responsibility to notify the bank immediately of statement inconsistencies.
Section 8. Fees
Personal eBanking is provided to you free of monthly charge. As described more fully below, you can contract with a third-party vendor, Checkfree, for bill payment services. If you elect to contract for such services as part of your Personal eBanking, personal bill payment services are provided free of charge. Additional or different fee(s) may be imposed and any fee(s)amended from time to time in accordance with the Rules. All other fees applicable to your Accounts remain in effect.
Section 9. Equipment
We are not responsible for any loss, damage or injury resulting from (a) an interruption in your electrical power or telephone service; (b) disconnection of your telephone service by your local telephone company or from deficiencies in your line quality; or (c) any defect or malfunction of your PC, modem or telephone service; or (d) scheduled or unscheduled disruption of Personal eBanking Banking Systems. We are not responsible for any products or services relating to your PC, other than those specified herein. We also are not responsible for any damage to your PC, software, modem, telephone or other property resulting from the use of Personal eBanking including any damage resulting from a virus.
Section 10. Hours of Operation
Personal eBanking is available seven (7) days a week, 24 hours a day, except during maintenance periods or periods during which Personal eBanking otherwise is not operable. Transactions submitted after 5:00 p.m. local Michigan time on any business day will be processed the following business day. For all purposes herein, except where otherwise noted, business days are Monday through Friday, excluding holidays.
Section 11. Your Rights and Liabilities
Your rights and liabilities regarding losses that occur because your Logon ID or Password is used without your permission, or with respect to errors, are outlined in the "Your Deposit Account " disclosure in the section titled "Electronic Funds Transfers Your Rights and Responsibilities". Section 12. Authorization to Obtain and Disclose Information
In addition to the other provisions of the Rules, you agree that we may obtain information regarding your Payee Accounts and disclose information about your Accounts to third parties in order to support bill pay services.
Section 13. Termination
You may terminate your use of Personal eBanking at any time by written notification. You must notify us at least ten (10) Business Days prior to the date on which you wish to have your enrollment in Personal eBanking terminated. We require that your request be in writing. We may terminate at any time your access to Personal eBanking, in whole or in part, for any reason without prior notice. Your access to Personal eBanking will be terminated automatically if your Accounts are closed, or access to your Accounts is restricted for any reason. SIX MONTHS OF PERSONAL EBANKING INACTIVITY WILL RESULT IN AUTOMATIC SERVICE TERMINATION. Termination will not affect your liability or obligations for transfers we have processed on your behalf. Funding for scheduled bill payments continues as your responsibility despite termination.
Section 14. Limitation of Liability
Except as otherwise provided herein or by law, WE ARE NOT RESPONSIBLE FOR ANY LOSS, INJURY, OR DAMAGE, WHETHER DIRECT, INDIRECT, SPECIAL, OR CONSEQUENTIAL, CAUSED BY PERSONAL EBANKING OR YOUR USE OF PERSONAL EBANKING OR ARISING IN ANY WAY OUT OF THE INSTALLATION, USE, OR MAINTENANCE OF ANY SOFTWARE OR OTHER MEANS OF ACCESSING PERSONAL EBANKING.
Section 15. On-line Bill Payment
You may elect to contract with Checkfree for bill payment services. Should you choose to do so, Firstbank shall have no responsibility for, or liability arising from, your use of such services. WE ARE NOT RESPONSIBLE FOR ANY LOSS, INJURY, OR DAMAGE, WHETHER DIRECT, INDIRECT, SPECIAL, OR CONSEQUENTIAL, CAUSED BY ONLINE BILL PAYMENT OR YOUR USE OF ONLINE BILL PAYMENT OR ARISING IN ANY WAY OUT OF THE INSTALLATION, USE, OR MAINTENANCE OF ANY SOFTWARE OR OTHER MEANS OF ACCESSING ONLINE PAYMENT.
